Terms of Service

1. Agreement

By downloading, accessing, or using Filter you enter a binding agreement with Softenwise under these Terms. If you do not agree, do not use the Service. Additional store terms (Apple App Store / Google Play) also apply to purchases and downloads.

2. Eligibility (18+)

You must be at least 18 years old and legally able to form a contract. You represent that the birth date and identity information you provide are accurate. We may suspend or terminate accounts that fail age or identity requirements.

3. Account

• You are responsible for credentials and for activity under your account.
• One natural person per account; no bots, scrapers, or bulk/fake profiles.
• Keep profile information truthful. Misrepresentation (including photos of others, stolen identity, or under-age claims) is grounds for immediate termination.
• We may refuse registration, require verification, or reclaim usernames at our discretion to protect the platform.

4. The Service (no outcome guarantee)

Filter provides question packs, preference filters, tournament-style candidate ranking, Gatekeeper (mutual accept, optional custom question), and chat after both people agree. Softenwise does not guarantee matches, responses, relationship outcomes, or continuous availability. Features may change, be limited by geography, or be discontinued.

Chat unlock requires Gatekeeper mutual acceptance as implemented in the product. Direct messaging outside that flow is not offered as a right.

5. Acceptable use & Community Guidelines

You must follow the Community Guidelines. Without limitation you must not:

• Harass, threaten, stalk, defraud, blackmail, or sexually exploit anyone;
• Post illegal, hateful, violent, or non-consensual intimate content;
• Spam, advertise third-party services without written permission, or scrape the Service;
• Circumvent safety, payment, rate limits, or access controls;
• Upload malware or attempt unauthorized access to systems or other users’ data.

We may remove content, sever matches, block users, warn, suspend, or permanently ban accounts — with or without prior notice — when we reasonably believe these Terms or Guidelines were violated or when required for safety or law.

6. User content license

You retain ownership of content you submit (photos, answers, messages). You grant Softenwise a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit that content solely to operate, secure, improve, and promote the Service (including showing your profile to other eligible users). This license ends for public display when you delete the content or your account, except for reasonable residual copies in backups, safety logs, or legal archives.

You warrant you have all rights to the content you upload and that it does not infringe others’ rights.

7. Safety tools

Report tools are available in the product (including unlocked chat). Blocking is optional — users may report without cutting match connections. Reports may be reviewed; we are not obligated to take any particular action except as required by law or store policies. Softenwise is not a party to user interactions and does not conduct criminal background checks on users.

8. Premium subscriptions & tokens

• Paid features (including Premium tiers and consumable tokens, if offered) are billed by Apple or Google unless we expressly state otherwise.
• Prices and benefits are shown in-app at purchase time and may change for future periods.
• Subscriptions auto-renew for the same period unless you cancel in the App Store or Google Play account settings before the renewal date.
• Refunds are handled by the respective store under their policies; Softenwise does not control store refund decisions.
• Unused promotional or token balances have no cash value and may expire as stated in-app.

9. Intellectual property

Filter, Softenwise names, logos, software, question packs, ranking logic, and UI are owned by Softenwise or its licensors. Except for the limited license to use the app as provided, no rights are granted. You may not copy, reverse engineer (except to the extent mandatory law allows), or create derivative works of the Service.

10. Third-party services

The Service may rely on third parties (hosting, push, payments, analytics). Their terms and privacy practices apply to their processing. Softenwise is not responsible for third-party outages beyond reasonable commercial efforts to restore service.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Softenwise does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOFTENWISE AND ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF FILTER OR INTERACTIONS WITH OTHER USERS.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SOFTENWISE FOR FILTER IN THAT PERIOD (EXCLUDING AMOUNTS PAID TO APPLE/GOOGLE THAT WE NEVER RECEIVE AS CASH), OR (B) EUR 50 (OR LOCAL EQUIVALENT).

Nothing in these Terms excludes liability that cannot be limited under applicable law (including certain consumer rights).

13. Indemnity

You will defend and indemnify Softenwise against claims, damages, and costs (including reasonable legal fees) arising from your content, your misuse of the Service, or your breach of these Terms or law — to the extent permitted in your jurisdiction.

14. Suspension & termination

You may delete your account in Settings. We may suspend or terminate access immediately for violations, risk, non-payment of entitlements abuse, or discontinuation of the Service. Provisions that by nature should survive (IP, disclaimers, liability limits, indemnity, governing law) survive termination.

15. Changes to the Service or Terms

We may modify features or these Terms. Material Terms updates will be posted with a new effective date. If you continue using Filter after the effective date, you accept the updated Terms where allowed by law. If you disagree, stop using the Service and delete your account.

16. Governing law & disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, except that mandatory consumer protections of your country of residence remain available where they cannot be waived. Courts of İstanbul, Türkiye shall have jurisdiction, subject to mandatory consumer venue rights.

17. Miscellaneous

If a provision is unenforceable, the remainder stays in effect. Failure to enforce a right is not a waiver. These Terms are the entire agreement regarding Filter between you and Softenwise and supersede prior conflicting summaries. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
